1. Acceptance of Terms

By accessing, browsing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, the Privacy Policy, and any other policies, guidelines, or rules published by Artjanta.

If you are using the Platform on behalf of an organization, institution, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms or any applicable policies, you must not access or use the Platform.

Your continued access to or use of the Platform after any updates or modifications to these Terms constitutes your acceptance of the revised Terms.

2. Definitions

The following definitions apply to these Terms of Service:

• Artjanta: Refers to the online platform, website, application, services, products, and features owned or operated by Artjanta.
• Platform: Means the Artjanta website, application, software, digital services, tools, and related technologies through which users access the services.
• Portal: Refers to the digital interface within the Platform through which users access their accounts, services, and platform features.
• User: Any individual that accesses, browses, registers, or uses the Platform, regardless of membership status.
• Community Member: A verified or subscribed user approved by Artjanta to access membership-specific features, professional opportunities, and community services.
• Profile: A user's personal or professional page containing information, portfolio, artwork, achievements, biography, and other details shared on the Platform.
• Artwork: Means any original or authorized creative work uploaded to the Platform, including paintings, drawings, sculptures, illustrations, photography, digital art, crafts, installations, performing arts media, designs, and similar creative works.
• Content: Means all information, text, images, videos, artwork, graphics, documents, blogs, comments, reviews, event listings, advertisements, and other materials uploaded, published, or shared on the Platform.
• Blog: Means an article, educational resource, opinion piece, tutorial, review, news item, or informational publication related to art or creative industries.
• Post: Means any content published by a user, including text, images, videos, announcements, discussions, or updates.
• Group: A community space within Artjanta created for members to discuss, collaborate, share knowledge, organize activities, or engage around common artistic interests.
• Portfolio: A curated collection of a user's artworks, projects, exhibitions, achievements, certifications, and professional experience displayed on their profile.
• Event: Means any exhibition, workshop, seminar, competition, festival, masterclass, performance, webinar, conference, or other activity listed or hosted through the Platform.
• Organizer: A user or organization that creates, manages, promotes, or conducts events, exhibitions, workshops, or other activities through Artjanta.
• Tutor: A verified individual or organization offering educational services, classes, workshops, coaching, or training through the Platform.
• Venue: Refers to a physical or virtual location listed on the Platform for hosting exhibitions, workshops, performances, events, or other creative activities.
• Subscription: Means a paid membership plan that grants access to specific features, services, or benefits for a defined period.
• Services: Include all features, tools, memberships, marketplace functions, event management, venue booking, tutor booking, blogs, networking, messaging, and other facilities offered by Artjanta.
• Intellectual Property: Includes copyrights, trademarks, designs, patents, trade secrets, logos, artworks, and other proprietary rights recognized under applicable laws.
• Applicable Laws: Means all local, state, national, and international laws, regulations, rules, and legal requirements applicable to the use of the Platform.

3. Eligibility

• Users must be at least 18 years old or have parental consent.
• Registration information must be accurate and kept up to date.
• Only one account per user is permitted unless explicitly approved.
• Providing false information may result in immediate account suspension.

4. Account Responsibilities

Users are responsible for:

• Protecting their account passwords and credentials.
• Maintaining overall account security.
• All activities performed through their account.
• Promptly notifying Artjanta of any suspected unauthorized access.

Users must not:

• Share their accounts with any other person.
• Sell or transfer their accounts.
• Create fraudulent accounts.
• Manipulate platform services or user parameters.

5. Community Membership

Membership is available only to eligible creative professionals. Applicants should:

• Belong to an art or creative field.
• Maintain authentic, complete profiles.
• Ensure artwork images accurately represent the physical work.
• Upload original work of their own creation.
• Comply with all platform policies.

Membership approval is at Artjanta's sole discretion.

6. User Content

Users remain fully responsible for everything they upload. Uploaded content includes:

• Artworks and portfolios.
• Blogs, articles, and reviews.
• Images, graphics, and documents.
• Videos and event content.

Users represent and warrant that they possess all necessary rights and licenses before uploading content.

7. Content Standards

Content must:

• Relate directly to art and creative industries.
• Be lawful under applicable rules and regulations.
• Be respectful of other users and groups.
• Be original and free from plagiarism.
• Avoid false, deceptive, or misleading information.

Prohibited content includes:

• Copyright infringement and piracy.
• Plagiarism of any form.
• Hate speech, abuse, or discrimination.
• Pornography or sexually explicit materials.
• Violence, graphic depictions, or terrorism.
• Malware, viruses, or spyware.
• Spam, unsolicited advertising, or links.
• Harassment, stalking, or defamatory material.
• Promotion of illegal activities.

8. AI Content

If AI-generated content is uploaded, users must clearly identify and label the content as AI-generated and remain fully responsible for compliance with copyright laws and platform standards.

9. Intellectual Property

Users retain full ownership of their artworks and creative uploads. Ownership is never transferred to the Platform.

By uploading content, users grant Artjanta a limited, worldwide, non-exclusive, royalty-free, revocable license to display, host, reproduce, distribute, promote, generate previews, and market the Platform.

10. Copyright Complaints

Copyright owners may submit infringement notices to the Platform. Verified infringing content will be removed promptly in compliance with copyright procedures.

11. Membership Plans

Memberships and subscriptions may include:

• Monthly membership plans.
• Quarterly membership plans.
• Annual membership plans.

Benefits, pricing, and features may change over time with prior notice.

12. Billing & Payments

Members agree to:

• Pay subscription fees according to the selected plan.
• Maintain valid, updated payment methods.
• Pay applicable taxes associated with transactions.

Failure to pay subscription fees may result in suspension of services.

13. Auto Renewal

Subscriptions may renew automatically at the end of the billing period unless cancelled before the renewal date.

14. Cancellation & Refunds

• Users may cancel their subscriptions at any time.
• Cancellation takes effect at the end of the current billing period unless otherwise stated.
• Fees are generally non-refundable except where required by law or expressly stated otherwise.

15. Marketplace & Sales

Community Members are responsible for:

• Accurate pricing of their listed items.
• Order fulfillment and prompt shipping.
• Maintaining correct banking details for payouts.
• Tax compliance on sales.

Platform commissions and transaction fees may apply and will be deducted from sales.

16. Community Conduct

Users must not:

• Harass, threaten, or insult others.
• Impersonate other individuals, artists, or organizations.
• Abuse members or write derogatory posts.
• Spam or post irrelevant links.
• Manipulate ratings, reviews, or user comments.
• Disrupt online events, chats, or workshops.
• Misuse exclusive platform features or benefits.

17. Moderation & Enforcement

Artjanta may, at its discretion:

• Review content uploaded to the platform.
• Restrict or filter content.
• Remove content violating platform standards.
• Suspend accounts or terminate memberships.
• Report illegal activities to authorities.
• Pursue legal remedies where appropriate.

18. Suspension & Termination

Accounts may be suspended or terminated for:

• Policy violations or platform abuse.
• Fraudulent activity.
• Copyright infringement.
• Abusive or disruptive conduct.
• Non-payment of subscription fees.

No refunds will be issued for accounts terminated due to policy violations.

19. Disclaimers

Artjanta is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Platform will be error-free, uninterrupted, or free from viruses.

20. Limitation of Liability

To the fullest extent permitted by law, Artjanta shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or goodwill.

Our total aggregate liability to you for any claim arising out of or related to these Terms shall not exceed the amount paid by you to Artjanta in the three months preceding the claim.

Artjanta shall not be liable for losses arising from user-generated content, unauthorized account access, third-party services, interruptions, or technical failures.

21. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22. Platform Intellectual Property

All content on Artjanta— including logos, design, text, code, graphics, and platform structure — is the intellectual property of Artjanta and protected by applicable Indian copyright law.

Artists retain full ownership of their uploaded artworks. By uploading, you grant Artjanta a non-exclusive, royalty-free licence to display and promote your artwork on the Platform and associated marketing channels.

You must not reproduce, distribute, or exploit any Platform content without prior written consent from Artjanta.
